Terms & Conditions & Cancellation Policy
Last updated: August 2026 · General terms and conditions for private boat tours by Tanja Katrin Schneider (Sunset Tours Mallorca), Santa Ponsa, Mallorca.
1. Scope and contracting party
These terms apply to all bookings of private sunset tours with Tanja Katrin Schneider, Via de la Cruz 46, 07180 Santa Ponsa (Calvià), Illes Balears, Spain (hereinafter "we"). Deviating terms proposed by guests shall only apply if we have agreed to them in text form.
2. Booking and formation of the contract
Enquiries via the contact form, e-mail, phone or WhatsApp are non-binding. The contract is only formed once we confirm the booking in text form with date, time, tour option and price.
3. Services
The booking is for a private trip for a maximum of 4 guests on an 8-metre yacht with a skipper, including fuel, drinks and the services listed in the respective tour description. Route, anchor points and schedule are indicative and may be adjusted for safety, weather or regulatory reasons.
4. Prices and payment
The price stated in the booking confirmation applies. Unless otherwise agreed, payment is due before or at the start of the trip. Any taxes are included in the price.
5. Cancellation by guests
Unless otherwise agreed in the booking confirmation, the following applies: cancellations up to 72 hours before the start of the trip are free of charge. After this period, or in the event of a no-show, we may charge the agreed price, less any expenses saved and any amount obtained by re-booking the slot elsewhere.
6. Weather, sea conditions and cancellation by us
Safety on board takes priority. In the event of unsuitable weather or sea conditions, technical faults or regulatory orders, we may postpone, shorten or cancel the tour. In such cases, we will offer an alternative date; if this is not possible, we will fully refund any amounts already paid. Further claims exist only in cases of intent or gross negligence.
7. Obligations on board
The skipper's instructions must be followed at all times. We may refuse to take on board persons under the influence of alcohol or drugs. Children must be supervised on board; life jackets are provided. Swimming is at the guest's own risk and subject to the skipper's instructions.
8. Liability
We are liable without limitation for damages resulting from injury to life, body or health, as well as in cases of intent and gross negligence. Otherwise, liability is limited to breaches of material contractual obligations and to typical, foreseeable damage. We accept no liability for valuables brought on board.
9. Cancellation/withdrawal notice
Important notice: For contracts relating to leisure services provided at a specific date or period, there is no statutory right of withdrawal (Art. 103(l) Royal Legislative Decree 1/2007 – TRLGDCU, corresponding to § 312g(2) no. 9 BGB). Our tours fall under this exception, as they are booked for a fixed date.
Irrespective of this, our fair cancellation terms under clause 5 of these Terms & Conditions apply.
10. Photographic material
Photos taken during the tour will only be published with your express consent. Any consent given may be withdrawn at any time with future effect.
11. Dispute resolution and applicable law
Spanish law applies; mandatory consumer protection provisions of the guest's country of residence remain unaffected. The EU online dispute resolution platform can be found at ec.europa.eu/consumers/odr. We are not obliged and, in general, not willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
Should any provision be invalid, the validity of the remaining provisions shall remain unaffected. Further details can be found in the Legal Notice and in the Privacy Policy.
